Professional elections in companies with 11 to 20 employees

Article L. 2314-5 paragraph 5 of the French Labor Code provides that in companies with 11 to 20 employees, the employer invites trade union organizations to negotiate a pre-electoral agreement, as long as at least one employee has applied for the professional elections within 30 days following the information of the staff on the organization of the elections, as referred to in article L. 2314-4. On August 8, 2023, a new CERFA was published by the French authorities, renumbered n°15248*05. This CERFA includes a new box for companies with a workforce of between 11 and 20 employees, in which the dates of the two rounds of voting must be postponed when a deficiency has been noted. Thus, in companies with 11 to 20 employees, in the absence of applications within the 30-day period, the employer is not exempt from organizing elections (it is only exempt from inviting union organizations to negotiate the pre-election agreement). Furthermore, as of July 24, 2023, the postal address of the CTEP has changed:
